About these terms
This website is operated by Vic Offroad Pty Ltd (ABN 52 167 602 780), trading as Vicoffroad. In these terms, "we", "us" and "our" mean Vic Offroad Pty Ltd, and "you" means you, the person using the site or placing an order.
These terms apply when you use vicoffroad.com.au and when you buy from us. By using the site or placing an order, you agree to them.
They work alongside our Privacy Policy, our returns policy and our warranty. Where those documents cover something specific, they apply.
Using this website
You need to be at least 18 and able to enter a contract.
If you create an account, keep your login details private and let us know if you think someone else has used your account. You're responsible for what happens under your login.
We may change, suspend or withdraw any part of the site at any time. We try to keep it available, but we can't promise it always will be.
Product information
We work hard to keep product information accurate, and mistakes still happen.
Specifications, dimensions, weights, images and compatibility information are a guide. Manufacturers change their products, and images may not show the exact variant, colour or included accessories.
If getting a detail exactly right matters to your purchase, contact us before you order and we'll confirm it.
Fitment and compatibility
Where we list a product as suiting a particular vehicle, make, model or year range, that information is a guide based on what the manufacturer tells us.
You are responsible for checking the product suits your vehicle and your intended use before you buy. Vehicles vary by build date, trim, market and previous modifications, and two vehicles with the same badge are not always the same underneath.
If you aren't sure, contact us before ordering.
Installation and safe use
Many of our products affect vehicle safety. That includes bull bars and nudge bars, towing equipment, roof racks and rooftop tents, load-carrying accessories, and 12V electrical equipment.
- Follow the manufacturer's instructions that come with the product
- Have products installed by a suitably qualified person where the instructions call for it, or where installation affects vehicle safety or roadworthiness
- Do not exceed stated load ratings, weight limits or electrical ratings
- Make sure the installation complies with the road rules and vehicle standards that apply where you live, which vary by state and territory
We aren't responsible for loss or damage caused by incorrect installation, modification of a product, use beyond its rated limits, or use that doesn't follow the manufacturer's instructions.
Orders
When you place an order you're making an offer to buy. A contract forms when we send you a dispatch confirmation, not when you receive an order confirmation email and not when payment is taken.
We may decline an order, and we'll tell you and refund you in full if we do. Reasons include stock not being available, a pricing or listing error, a delivery address we can't service, or a suspected fraudulent order.
Pricing
Prices are in Australian dollars and include GST unless stated otherwise. Delivery is charged separately unless the product says it ships free.
We can change prices at any time. A change won't affect an order we've already accepted.
If a product is listed at an obviously incorrect price, we aren't required to supply it at that price. We'll contact you, and you can confirm the order at the correct price or cancel it for a full refund.
Stock
Listing a product doesn't guarantee it's in stock. Stock levels shown on the site are indicative, and we sell through more than one channel.
If we can't supply something after you've ordered, we'll contact you with the options and refund you in full if you'd rather not wait.
Payment
We accept the payment methods shown at checkout. Payment must clear before we dispatch.
We don't store your card details. Payments are handled by our payment providers.
Delivery
Delivery costs, timing and coverage are set out in our shipping information.
Risk in the goods passes to you on delivery. Title passes when we've received payment in full.
Delivery estimates are estimates. We can't control carrier delays.
Changing or cancelling an order
Tell us as soon as possible if you need to change or cancel an order. We dispatch quickly, so we can't promise to catch it in time.
If the order has already left our warehouse, cancelling is treated as a change of mind return under our returns policy.
Returns and warranty
Change of mind returns, faulty items and warranty claims are covered in our returns policy and warranty. Those policies form part of these terms.
Your rights under Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these terms excludes, restricts or modifies any right you have under the Australian Consumer Law.
Reviews and other content you post
If you post a review, photo, question or comment, you're responsible for it. Keep it honest, keep it lawful, and don't post anything that isn't yours to post.
By posting, you give us permission to use, display and share that content in connection with our business, including in marketing.
We can remove content that's misleading, offensive, infringes someone's rights, or breaches these terms.
Reviews should reflect genuine experience. We don't edit reviews to change their meaning, and we don't remove reviews just for being critical.
Our intellectual property
The content on this site, including text, images, layout and the Vicoffroad name and logo, belongs to us or to the brands we stock, and is protected by Australian and international law.
You can browse the site, and print or save pages for your own use. You can't copy our product copy, images or site content for commercial use, or use our name or logo, without our written permission.
If you're an affiliate or a dealer, your agreement with us sets out what you can use.
We take our intellectual property seriously, and we will act to protect it where it's used without permission.
Reporting an intellectual property concern
If you believe something on our site, or one of our products, infringes your intellectual property, email us at sales@vicoffroad.com.au and tell us:
- Who you are, and how to reach you
- What right you say has been infringed, and the basis on which you hold it
- Exactly which product, page or content you're referring to, with a link where you can
We'll look into it and come back to you. Where the concern relates to a product we stock rather than content we've created, we may need to raise it with the brand or supplier as part of that.
Things you must not do
Don't use the site to break the law, interfere with how it works, gain access to parts of it you're not meant to reach, introduce anything malicious, or scrape it with automated tools without our permission.
We can suspend or close your account if you do.
Links to other websites
We link to other sites for convenience. We don't control them and aren't responsible for their content or their handling of your information.
Our liability
Nothing in this section limits your rights under the Australian Consumer Law or any other law that can't be excluded.
Subject to that, and to the extent the law allows:
- We're not liable for indirect or consequential loss, including lost profits, lost revenue or lost business opportunity
- Where we are liable, our liability is limited to resupplying the product or refunding what you paid for it
Changes to these terms
We may update these terms. The current version is always on this page, and the date at the top tells you when it last changed. Changes apply to orders placed after they're posted.
Governing law
These terms are governed by the laws of Victoria, Australia. Disputes will be dealt with by the courts of Victoria.
